Lancaster Township man accused of breaking into police officer’s home has charge withdrawn

A Lancaster Township man accused of breaking into a Jackson Township police officer’s home had a felony burglary charge withdrawn at a Wednesday, Sept. 30, preliminary hearing.

Tyler Stephen Mitro, 32, waived to court his remaining felony trespassing charge and summary counts of public drunkenness and criminal mischief before District Judge Amy Marcinkiewicz. He was charged Sept. 19 by Zelienople police following the incident.

Police said the wife of the Jackson Township police officer had called him that night to report a man was inside their residence and refused to leave. The officer went home before Zelienople police arrived and apprehended Mitro on the back porch of the home.

Mitro showed signs of impairment during the incident, according to charging documents.

Police said the woman awoke to loud banging coming from the first floor of the home before calling her husband. She then found Mitro standing in the kitchen. Police said Mitro repeatedly refused to leave but eventually walked outside and stood on the back porch.

Mitro posted his $25,000 bail on Sept. 20, a day after it was set. According to his release conditions, Mitro will undergo pretrial supervision, a drug and alcohol evaluation and must stay away from the area of the officer’s home.

Mitro was represented by attorney Stephen Colafella of Tucker Arensberg Attorneys.
