A 32-year-old man was sentenced today in Butler County Court for his fifth drunken driving conviction in 10 years.

Royal F. Tolbert, Jr. was sentenced to serve 90 days in county prison, followed by another 6 to 12 months behind bars for another case.

Court records say Tolbert pleaded guilty to driving under the influence of alcohol, driving with a suspended license and a windshield violation in November 2007.

The charges, according to court records, were filed by state police May 22, 2007.

"Where have you been for the past two years?" Butler County judge William Shaffer asked of the defendant, who has been wanted on a county bench warrant since failing to show up for sentencing that same year.

"They did not look for me. I did not report," Tolbert said of officials in Beaver County, where the defendant lives and also was on court supervision for a 2006 forgery case.

Tolbert told Shaffer today that he's just starting to turn his life around. And, knowing there was an active warrant for him "weighed on his conscious" so he turned himself in for sentencing.

"I decided it was time to come up here and get this in order," Tolbert said, noting that his failure to report his whereabouts also accrued him a concurrent nine month prison sentence from the Beaver County Courts.

Shaffer, in addition to the prison time, ordered Tolbert to pay $2,000 in fines and log in 60 hours of community service.
