A Butler Township man is facing charges after police said he waved a gun around during an argument Tuesday, Sept. 22, at a Metzger Avenue home.

Matthew Brian Swarens, 42, was charged Wednesday with felony prohibited possession of a firearm and misdemeanor simple assault after police said a woman was struck by a bullet that was ejected from the gun that Swarens was waving around.

Butler Township police said it responded to a call that indicated Swarens and a woman were fighting and throwing objects. The caller reported that Swarens was in possession of a firearm.

Police said that, during the argument, Swarens reportedly retrieved a 9 mm pistol and was waving it around while manipulating the slide, causing it to eject rounds. One struck the woman, police said.

Police said Swarens was adjudicated delinquent in 1999 for felony robbery in Broward County, Florida, and was prohibited from possessing firearms due to a protection from abuse order in Colorado.

Swarens is being held in Butler County Prison under $15,000 bail. He is currently awaiting a preliminary hearing under District Judge Kevin O’Donnell.
