From what I know of the ACCESS program, the card won't work to purchase items other than those classified as food. I'm not certain what the particulars of the programming are, but if I had to guess I'd say that it's actually the business that's responsible for incorrectly (intentionally or neglectfully) labeling their goods. Either that, or there's some major miscommunication between the state and retailers.
