Charges dropped in assault of police officer

Charges were dropped on Monday against a Butler man accused of assaulting a police officer in June.

Mark A. Lilley, 27, was facing a felony charge for allegedly assaulting a patrolman in June and a misdemeanor resisting arrest. The confrontation with police also landed Lilley in Butler County Prison in lieu of $75,000 bail.

But after prosecutors considered Lilley's situation — a family man with no criminal record — they released him from jail and on Monday they dropped the charges against him, replacing them with summary offenses of public drunkenness and disorderly conduct.

According to Lilley's lawyer, Andrew Stiffler, the agreement was reached after he met with Patrolman Michael Sulerud, the arresting officer.

“The DA's office and the arresting officer were very understanding,” Stiffler said, explaining that they had come to an agreement that Lilley would complete 30 hours of community service and undergo drug and alcohol treatment. If these conditions were met by the time of Monday's hearing, Stiffler said, prosecutors and police agreed to dropped the case.

Authorities also were sympathetic to Lilley's situation since he did not have a previous criminal history. And on Monday, the deal was concluded with the conditions met.

Police arrested Lilley on June 2 on Race Street after officers were called for a fight between two men, neither of whom was Lilley.

Lilley showed up and “demanded to know what was going on,” according to charging documents. Police suspected Lilley had been drinking alcohol.

He allegedly refused to leave and became “aggressive.” When Sulerud tried to place him on the curb, Lilley spun around and struck the side of the officer's head with his hand.
