Charges advance for man accused of firing into home on East Wayne Street

Co-defendants waive, continue preliminary hearings

A Duncansville man accused of shooting a gun into a residence due to having a “beef” with a resident had all charges held for court in a preliminary hearing on Monday, Feb. 2.

Kaleb Gene Beish, 22, was charged with four felony counts of discharging a firearm into an occupied structure, felony aggravated assault and four misdemeanor counts each of reckless endangerment following the alleged Jan. 19 shooting into an apartment on East Wayne Street.

Resident Charlie Burdick testified before District Judge William Fullerton there were three other people in the home at the time of the shooting. She said the shooting occurred between 1 and 1:30 a.m. after a friend had asked to stay the night.

Burdick said later, after the friend arrived, he woke Burdick around 1 a.m. talking about another friend who had come over to talk. She said the friend was told to leave and walked outside around the building to call for a ride.

Burdick said that about five minutes after she left, a black two-door Dodge Challenger driven by James Michael Dent, 23, of Butler, pulled in front of the residence.

Dent was charged with four felony counts of discharging a firearm into an occupied structure and conspiracy to commit aggravated assault, one felony count of intimidating a witness or victim and conspiracy to commit aggravated assault and four misdemeanor counts of reckless endangerment.

He and defense attorney Michael Ozdinec, of Ozdinec and Witzel, waived Dent’s preliminary hearing Monday.

Burdick said her friend went outside to meet the vehicle, but she pulled her friend back inside and locked the door. Around the same time, Burdick said Beish came around the side of the house to the front glass door and motioned with a black and gray gun through the door. Burdick said she had never seen Beish before this.

Burdick said she and her friend then fled to the back bedroom before Beish allegedly opened fire.

Burdick said she believed five rounds were fired into the home and she found bullet holes in the front door and couch. She said one person in the bedroom was also grazed in the arm by a bullet.

Police responded and found the front glass door shattered with glass laying around it, Butler police officer Benjamin Drake said. Police found three .38-caliber shell casings in the street and one slug in the bedroom.

Public defender Terri Schultz argued the felony aggravated assault charge against Beish should be dropped because it was in reference to Burdick’s friend and there was no gun pointed at the friend, she said. Fullerton kept the charge and said it relates to the course of the incident, not an individual victim.

Police added that Beish placed a call Jan. 22 from Butler County Prison to Shaena Renae Hale, 30, of Tyrone, saying there would be no evidence to convict him if the four people said he didn’t do it, according to Hale’s affidavit.

On Jan. 26, one of the four other people who lives in the first apartment that was shot went to the police station and reported Dent and Hale invited her to Dent’s home to talk about the incident. During the conversation, Hale offered to pay her $1,000 if she didn’t testify against Beish, according to the affidavit.

Hale was charged with felony intimidating witnesses and her preliminary hearing was continued. She was released on a non-monetary bond due to her pregnancy.

Dent was also released on a non-monetary bond. His and Beish’s formal arraignments are scheduled for 1 p.m. March 24 in Butler County Common Pleas Courtroom 5.

Beish is being held in Butler County Prison on $250,000 bail.
