Judge releases to house arrest man accused of sexual assault
A man being held in Butler County Prison on charges of sexually assaulting a minor will be released on house arrest and pretrial supervision after a district judge Tuesday decided his health conditions would be better treated at home.
Ivan Cumba, 47, of Butler has been held in the county jail since his arrest Sept. 6, when state police received reports that Cumba molested and fondled a 14-year-old girl on separate occasions in November 2018. He was charged with two counts of aggravated indecent assault, two counts of corruption of a minor, two counts of indecent assault and one count of disorderly conduct.
District Judge Lewis Stoughton initially arraigned him on a $50,000 bond, but on Tuesday Stoughton agreed to put Cumba on pretrial supervision after his lawyer, Ryan Helsel, and Assistant District Attorney Russ Karl noted that Cumba's long list of health issues posed too much of a burden on the jail's resources.
As part of Cumba's release conditions, he isn't allowed to contact the victim.
During a forensic interview at the Butler County Alliance for Children, a 14-year-old disclosed that Cumba fondled her breasts and sexually assaulted her with his fingers.
The girl told authorities that this occurred on two occasions within a week in November 2018 at the her residence in Petrolia. She also said that Cumba knew her.
Cumba will be formally arraigned Dec. 10.
