MERTZTOWN, Pa. — A 60-foot tree toppled by high winds fell onto a sport utility vehicle traveling along a Berks County road, killing a man and critically injuring his wife, state police said.

The Chevrolet Trailblazer was traveling at about 50 mph on Woodside Avenue when the tree fell directly onto its roof, causing "massive damage to the occupant area" of the vehicle, police said.

The SUV veered to the berm and came to rest against another tree after the accident, which happened just before 3:30 p.m. Sunday.

Dean R. Derr, 48, of Kutztown, was pronounced dead of massive head injury at the scene, police said. Cynthia S. Derr, 49, was taken to Lehigh Valley Hospital in critical condition, police said.

ERIE — A Meadville woman who says Michael Jordan fathered her child says she will fight a civil suit filed against her by the former NBA star and also plans to write a book about her relationship with him.Earlier this month, a Crawford County judge granted Jordan a preliminary injunction against Miceli, forbidding her from communicating or contacting him, his family or any of his representatives.Miceli, 35, says Jordan is the father of her 4-year-old son and has not denied having had a relationship with her. Jordan said in his lawsuit that two paternity tests in 2005 ruled him out as the boy's father.The former NBA star's lawyer, Frederick J. Sperling, said the civil suit "says everything that Michael Jordan has to say."The civil suit alleges that Miceli violated a 2005 no-contact agreement with Jordan, sending the basketball star and those acquainted with him hundreds of e-mails and voice mail messages.Miceli said the messages were sent as she became frustrated at her failure to get Jordan to acknowledge their relationship and the child. Miceli and her son now lives with her parents in Meadville.
