DUI suspect has charges reduced to misdemeanors
SLIPPERY ROCK — A Slippery Rock man charged with driving under the influence saw his charges reduced from felonies to misdemeanors Wednesday.
Darryl J. Armstrong, 53, initially was arrested and charged with two felony driving under the influence charges and a summary charge. He had received felony counts because he had three previous DUI convictions.
Armstrong waived his preliminary hearing Wednesday before District Judge William S. O'Donnell, and his public defender, Joe Nash, talked with Assistant District Attorney Russell Karl about the previous offenses.
Karl said Armstrong's previous convictions were beyond the time frame that would upgrade his current case to felony counts.
“His priors were outside of 10 years,” Karl said.
According to the criminal complaint, state troopers pulled Armstrong over after his vehicle failed to stop at a red light.
The report said Armstrong admitted to having a “few” drinks after work.
Police said Armstrong's breath testing revealed a blood-alcohol content of .204 percent.
In Pennsylvania, a level of .08 percent is considered intoxicated.
Having been released on his own recognizance following his arrest, Armstrong left the courtroom Wednesday with two misdemeanor DUI counts and a traffic violation.
Armstrong's next court date was not available.
