Accused killer heads to juvenile court

Police say teen shot, killed father

PITTSBURGH — A 13-year-old girl accused of fatally shooting her father, allegedly after years of sexual abuse, will be tried in juvenile court.

Allegheny County District Attorney Stephen Zappala Jr. made that decision Friday morning after visiting the house where 34-year-old Matthew Booth died of a shotgun wound to the head early Monday.

"She's going to stay in the juvenile system," Zappala said.

Zappala decried the deplorable condition of the house and said it was a major factor in his decision to prosecute Booth's daughter as a juvenile.

"What was described in terms of how she was living — it's just incredible," Zappala told reporters outside the house in Elizabeth Township.

Police said officers found animal feces and the stench of cat urine throughout the house when they entered Monday. Animal welfare officials took away several animals, including dogs, cats and rabbits, and Zappala said the house is in such bad shape that it may need to be torn down.

The girl told investigators she used a 12-gauge shotgun to shoot Booth in the face, and her attorney, Patrick Nightingale, said she had endured years of sexual abuse. The Associated Press does not identify possible victims of sexual assault.

The girl had been charged as an adult with criminal homicide.

In a petition to have the girl tried as a juvenile, Nightingale said the girl is more amenable to be rehabilitated under the juvenile system and the public interest would not be served by trying her as an adult.

If adjudicated delinquent in juvenile court, the girl could face a variety of punishments, including probation, detention in a juvenile facility or electronic home monitoring, Nightingale said. The court would have jurisdiction over her until she turns 21.

A judge on Thursday ordered the girl moved from the county jail to a mental institution after a psychiatrist testified that the girl suffered from an unspecified mood disorder and that her judgment was severely impaired.

The girl was taken Friday to the Western Psychiatric Institute after waiving her right to a preliminary hearing.

After her stay at the clinic, the girl will be returned to the county's juvenile detention center.
