Woman faces trial in fatal shooting case

A Butler County woman is headed for trial on charges stemming from the fatal shooting of a man during an alleged robbery in Westmoreland County.

Bailey Ann Hines, 24, of Butler Township was ordered held for court on homicide and other charges at a preliminary hearing Thursday in New Kensington.

District Judge Frank Pallone Jr., in the ruling, also dismissed a charge of conspiracy to commit homicide, following testimony at the hearing.

Hines and her alleged accomplice, Allen D. Herring, 32, of Braddock, Allegheny County, remain in the Westmoreland County Prison, each without bond.

Herring previously waived the right to his own preliminary hearing on homicide and other charges, and he, too, is awaiting possible trial.

According to court documents, Hines and Herring plotted to rob 35-year-old Gregory R. Wynkoop in Arnold on the evening of June 28.

A heavy-equipment operator, Wynkoop of East Franklin Township, Armstrong County, later died of a gunshot wound at Allegheny Valley Hospital in Natrona Heights. He was the married father of three children.

Arnold police found the victim in and around a vehicle that had wrecked into the back of a house after officers responded to a call for shots fired, according to Westmoreland County detectives.

During the investigation, authorities spoke to Hines. In a July 2 interview, according to charging documents, she said that Wynkoop had picked up her and another woman “because he was interested in buying (crack cocaine).”

He gave the other woman, who has not been charged, $70 for the supposed drug deal. The other woman handed the money to Hines to get the drugs.

The women left Wynkoop in his car in an alley way, and went to meet Herring. He was advised the victim had “a lot of money,” documents said.

Hines, at Herring's request, allegedly called Wynkoop and asked the victim to pick her up. While riding in the car, investigators said, Hines called Herring.

She picked up her suspected accomplice, who got into the car. Herring told Wynkoop to pull into the alley way, documents said.

Hines recounted to investigators that as she got out of the vehicle, she heard Herring tell Wynkoop to give him his wallet. She then heard gunfire, and ran off.

Herring later met with Hines and the other woman, documents said, and told them that he had shot Wynkoop “while they were wrestling for a gun while he was robbing him.”

He also allegedly gave Hines $300 of the money taken from the victim's wallet.

During a July 8 interview, detectives said, Herring, a felon, told investigators that he and Hines had decided that “they were going to rob the victim while Herring was acting as a drug dealer.”

The other woman also corroborated the alleged robbery plot hatched by the defendants, authorities said.

Herring and Hines were arrested July 8 and Aug. 14, respectively.

At Hines' hearing, she was ordered bound over for court on charges of homicide, robbery and conspiracy to commit robbery.

Emily Smarto, Hines' court-appointed attorney, said Friday that she was pleased with Pallone's ruling to dismiss the conspiracy to commit homicide charge. “It was appropriate,” she said, because the prosecution did not present sufficient evidence to hold the charge. She was unavailable for further comment.

Prosecutor Peter Caravello, a county assistant district attorney, declined comment, citing the ongoing case.

Hines, meanwhile, is due in Butler County court Oct. 1 for formal arraignment on unrelated criminal charges stemming from a July 28 incident at the Comfort Inn off Route 8 south in Butler Township.

She was arrested on charges she tried to hide from township police $30 that she allegedly stole from an employee break room at the hotel.

Police were investigating the reported theft of the money from a purse when they spoke to Hines, a housekeeper at the hotel. She denied taking the money, according to court documents.

Later, while still at the hotel, an officer watched her walk to the outdoor patio and hide the suspected stolen money under a patio stone, documents said.

Hines is charged with tampering with physical evidence, theft and receiving stolen property, all misdemeanors.

Following her arrest, she was placed in the Butler County Prison on $25,000 bond. But on Aug. 8, she was released on her own recognizance after waiving her preliminary hearing in the case.
