CEO pleads guilty to writing off mansion funds as business expenses

The former president and CEO of a health systems company pleaded guilty to writing off millions of dollars in business expenses to fund the construction of his mansion.

Joseph W. Nocito, 80, of Sewickley, pleaded guilty to conspiring to defraud the United States before Senior U.S. District Judge Joy Flowers Conti, according to a Friday news release from the Department of Justice.

According to the news release, between 2006 and 2012, Nocito fraudulently wrote off millions of dollars as CEO and president of the Pittsburgh-based Automated Health Systems as business expenses against other companies he owned.

The money would be used on his 39,000-square-foot Bell Acres home known as “Villa Noci,” including both the exterior and interior construction, design and furnishings, an outdoor pool, landscaping for the grounds and a playground, tennis court and bocce court.

Nocito also fraudulently expensed millions of dollars for other personal expenses such as luxury vehicles, personal fitness and private school tuition for grandchildren. Nocito avoided paying about $4 million in personal income tax on his 1040 personal income tax returns between 2006 and 2012, causing the filing of false personal and corporate income tax returns.

Nocito also avoided paying about $11 million in corporate income tax by shuffling millions of dollars through other companies he owns, and falsely characterized the transfers as management, administrative or consulting expenses. This let him to significantly under report company profits and by concealing AHS Inc. taxable income, the news release said.

As part of the guilty plea, Nocito agreed to pay criminal restitution to the Internal Revenue Service $15,824,056 prior to his sentencing date.

Conti scheduled sentencing for March 23, where Nocito could face up to five years in prison, a fine of $250,000, or both.
