PITTSBURGH — State Sen. Jane Orie, R-40th, intends to resign by the time she’s scheduled to be sentenced on campaign corruption and forgery charges later this month, although her attorney has asked the court to delay the sentencing hearing for two months.

Her district includes southern Butler County.

Orie’s attorney wants to delay her scheduled May 21 sentencing so he has more time to prepare witnesses and to continue gathering character reference letters.

“Sen. Jane C. Orie intends to formally resign from the Senate of Pennsylvania on or before May 21, 2012, even assuming this motion is granted,” her attorney, William Costopoulos wrote in the motion.

Orie’s chief of staff, Mike Sarfert, confirmed that she’s not been able to vote because she’s been on house arrest and has taken personal leave as a result since her conviction March 26.

Allegheny County Judge Jeffrey Manning was vacationing today and has yet to see Costopoulos’ motion or to schedule a hearing on it. A district attorney’s spokesman said the prosecutor will object to the requested delay.

The lawmaker from McCandless was convicted of 14 of 24 counts.

A jury agreed with prosecutors that Orie illegally used her state-funded staff to do campaign and political fundraising work for nearly a decade, and that she forged some documents.
