DEP fines Indspec Chemical for October spill
PETROLIA — Indspec Chemical is facing another fine in connection with a chemical spill in October that evacuated the borough.
The state Department of Environmental Protection levied a $34,187 penalty against the company, the department announced Wednesday. Previously, the federal Occupational Safety and Health Administration announced a fine against the company of more than $120,000.
Both fines stem from an incident Oct. 11 when an oleum tank overfilled because of a failed electrical connection. The spill caused fumes to leak into the air and a dense, low-lying cloud, much like a sulfuric acid cloud, covered the plant.
Residents in a 3-mile radius were evacuated.
Plant manager Dave Dorko said Wednesday the company has worked cooperatively with the DEP in its investigation. That cooperation led to this consent agreement, he said.
"This constitutes a settlement," Dorko said, adding the company doesn't plan to appeal the order.
The plant manufactures industrial organic chemicals, including resorcinol, an industrial adhesive.
It employs about 260 workers. However, those workers were laid off in March.
OSHA cited the plant for 27 violations, but after that was announced Dorko said he might challenge the fines if another settlement couldn't be reached.
The fines announced Wednesday by DEP include violations of the Storage Tank Act and the Air Pollution Control Act.
