BUTLER TWP — A Texas man was arrested for drunken driving after he was caught driving a motorcycle with a bottle of whiskey between his legs, police said.

Edwin E. Carter Jr., 48, of Tyler, a truck driver, is free on $5,000 bail while awaiting his preliminary hearing Aug. 16 on driving under the influence and other charges stemming from last weekend's traffic stop.

Butler Township police said they began looking for the defendant about 8:45 p.m. Friday, after a 911 caller reported seeing a possibly impaired driver leave the Wine and Spirits store at Moraine Pointe Plaza and take off on a motorcycle.

The cyclist was described as driving “erratically” and “swerving” in the parking lot. At one point he was seen dropping the bike, which had a Texas license plate.

An officer eventually spotted the cycle at a red light on New Castle Street at Hansen Avenue in Butler. The driver, according to court documents, was “revving” the engine while waiting for the light to change.

The officer moments later conducted a traffic stop at the Fifth Avenue intersection.

Police identified Carter and they smelled alcohol on his breath. The officer, police said, also noticed a bottle wrapped in a plastic bag between his legs. The bag was from the state store.

In the bag was a bottle of Fireball whiskey, documents said.

Carter refused to perform field sobriety tests and he declined to submit to a portable breath test device. Police said he also would not take a formal breath test at the station.

In addition to DUI, he is charged with driving an unregistered vehicle and careless driving.
