Man charged again in alleged stabbing
Butler police Monday refiled an attempted homicide case against a suspect in a city stabbing in April.
John Patrick Conley III, 25, who has no known address, is again charged with the knife stabbing of 34-year-old Jesse Markovitz of Butler at a home on North Elm Street.
Just last week, District Judge Pete Shaffer dismissed the case against Conley after Markovitz failed to appear at the defendant’s preliminary hearing.
Markovitz’s no-show on June 16 was the second time he did not appear for Conley’s hearing before Shaffer.
Police said the first time Markovitz did not show up, May 19, he had an excuse. He was at a drug rehabilitation facility.
But last week was a different story. Police had no idea of his whereabouts.
The so-called, “no victim, no case” principle kicked in, prompting Shaffer to dismiss all charges against Conley, who in turn was released from the Butler County Prison, where had been held on $250,000 bail.
Prosecutor Mark Lope, a Butler County assistant district attorney, at that time advised police that once they found Markovitz, they could refile charges against Conley.
“As luck would have it,” Lope acknowledged Monday, Markovitz showed up last Thursday in Butler County Court in connection with his own criminal cases.
He appeared before Judge Timothy McCune for sentencing in four separate 2013 cases, three for possessing drug paraphernalia and one for public drunkenness.
But his sentencing was delayed until July 10 after authorities suspected he had appeared there under the influence, Lope said.
McCune revoked Markovitz’s bail on his prior criminal cases, and he was placed in the county jail.
While police and prosecutors now know where he is. Lope admitted that Markovitz would likely be served a subpoena to ensure he is at Conley’s still-to-be scheduled preliminary hearing in connection with the April 2 stabbing case.
Police in that case allege Conley attacked Markovitz with a kitchen knife during an argument at an apartment in the 200 block of North Elm Street.
A short time later, officers found Markovitz at a home on nearby East Brady Street, where he had fled after the suspected attack.
He was treated at Butler Memorial Hospital for a stab wound to his upper back.
Conley the following day turned himself in on charges of attempted homicide and aggravated assault.
Police refiled those same charges against him, But on Monday they also charged him with simple assault stemming from an unrelated Sunday night domestic dispute.
In the latest case, Conley is accused of attacking and choking his girlfriend, 23-year-old Lois A. Daniels of Butler, at a home on Standard Avenue. He was gone by the time officers showed up.
Conley is wanted on arrest warrants in both cases.
Meanwhile, Daniels also is charged in connection with the April 2 stabbing. Police said she was with Conley at the apartment where Markovitz was attacked.
According to court documents, Daniels immediately after the stabbing gave investigators four different accounts of what happened.
Police subsequently charged her with hindering apprehension and unsworn falsification to authorities. Those charges are pending in Butler County Court.
