A Butler man is facing aggravated and simple assault charges after police said he placed a woman in a chokehold.

Damian Paul Winters, 23, was charged Wednesday, Sept. 30, with felony aggravated assault and misdemeanor simple assault following an incident that morning.

According to police, Winters’ mother reported that she could hear Winters and a woman fighting upstairs in her home. She told police that Winters fled the home before officers arrived.

Police spoke to the woman who said the fight started as an argument but escalated when she threw a small pillow at Winters. She told police Winters grabbed her by the throat and the two began to fight.

According to police, the woman said she slapped Winters who slapped her back before he pulled her hair and placed her in a chokehold from behind with his arms. Police said she told officers she felt herself beginning to pass out.

Police said the woman had redness on her neck and chest, red marks on her shoulder and her foot was bleeding.

Police said Winters was found at his grandmother’s house, where he told officers he choked the woman because she was punching him in the face.

Winters is being held in Butler County Prison under $10,000 bail. His preliminary hearing is set for 9 a.m. Oct. 8, before District Judge Kevin O’Donnell.
