Lawrence County caregiver sentenced over fatal medication mix-up
A Lawrence County personal care administrator will serve up to three years in prison for failing to renew a resident’s medications, which led to a fatal seizure in 2021.
Kelly R. Gonzales, 50, of New Castle, was sentenced to serve one to three years incarceration and pay $5,093 in restitution after being convicted at trial on one felony count of neglect of a care-dependent person and one felony count of endangering the welfare of a care-dependent person. Gonzales is also prohibited from serving in a personal care capacity while on supervision.
According to a news release from Pennsylvania Attorney General Dave Sunday, Gonzales was the administrator at ARC, a personal care home in New Castle, where she was tasked with managing of residents’ care. Those duties included ensuring residents received their prescribed medications in a timely manner.
The victim was a resident prescribed antiseizure medication. According to the attorney general, Gonzales knew the prescription had run out but did not fill it or instruct colleagues to do so.
Further testimony at the trial revealed two of Gonzales’ colleagues instructed her to take the resident to the emergency room to have his medication filled, but Gonzales never did, according to the attorney general.
According to the attorney general, the resident died at the care home on Dec. 2, 2021, after not receiving his medication for more than 10 days.
