Mustello small estate legislation moves to Senate
Last week Rep. Marci Mustello, R-11th, had legislation pass in the House of Representatives stating that probate assets are to be considered for limitation purposes when filing small estate petitions.
House Bill 2016 states that only probate assets will be considered when evaluating the $50,000 limitation on small estate petitions.
“By stating that non-probate assets are not to be counted towards the $50,000 limitation for small estate petition, House Bill 2016 addresses legal questions that can arise when the state features a mixture of significant non-probate assets but minor probate assets,” Mustello said.
The bill will now be up for consideration by the Senate.
