Hearing continued in burglary, trespass case
CHICORA — A man who was found stabbed in his Clearfield Township home last month will remain behind bars without bail after his preliminary hearing was continued Tuesday.
State police brought Kurt Leinenbach, 35, from Butler County Prison, where he has been since his arrest and arraignment Dec. 3.
Leinenbach had been released into police custody from a Pittsburgh hospital where he recovered from a stab wound suffered on the night of Nov. 10. Leinenbach's stabbing is intermixed into a number of alleged criminal activities that night for which he has been charged.
Leinenbach has five cases stemming from that night, including a combination of felony counts strangulation, burglary and criminal trespass, as well as a number of misdemeanors.
On Leinenbach's behalf, Public Defender Michael McFarland requested Tuesday's continuance, which was granted by District Judge Lewis Stoughton.
“We were unable to come to an agreement,” McFarland told the judge of his discussion with prosecutors.
The defense may have been requesting a bond be issued in the case or may have requested one or more of the charges be withdrawn before the preliminary hearing.
Multiple witnesses and the three state troopers involved in the cases attended Tuesday's hearing.
A date for the next preliminary hearing has not been set, but Stoughton noted that finding a time to meet all three state troopers' schedules will prolong the next hearing date. Stoughton said he will schedule it as soon as possible but estimated it could be scheduled anywhere from one month to six weeks away.
