Police: Woman threw urine at officer after CYS incident
A Butler woman is accused of throwing a container of urine at an officer, according to recently filed charges.
Misty A. Malone, 30, of Butler, was charged with felony aggravated assault on a police officer as well as misdemeanor resisting arrest and disorderly conduct, related to an incident at Malone's apartment.
Following her arraignment Wednesday by District Judge Sue Haggerty, Malone was placed in Butler County Prison on $25,000 bond.
Police arrived at Malone's apartment on the 400 block of West Penn Street, where they assisted Children and Youth Services investigating Malone's possible drug use, according to charging documents.
Police said near the end of the investigation, Malone agreed to a voluntary drug test, which was sitting on her front porch.
Based on a search of online court records, Malone does not appear to have a criminal history of any kind before the newly filed charges.
“As CYS and I were preparing to leave the scene, Malone became aggressive again and approached the CYS van and partially entered the van through the open passenger door, so that she could yell at the case worker, who was seated on the driver's side,” said the investigating officer in the affidavit.
Police said when they yelled at Malone to exit the van and attempted to diffuse the situation, Malone turned her attention to them.
“She began yelling at me, ran onto the porch, picked up the used drug test, which contained urine, and (she) threw it at me,” police said.
Police said they then arrested Malone, but to do so they needed to force her to the ground.
“Malone continued to scream and thrash about,” the officer said.
Malone will next appear for a preliminary hearing Dec. 20 before District Judge William Fullerton.
