A Commonwealth Court judge has granted summary relief of the state's school mask mandate, declaring it unenforceable.

Tom Breth, of Dillon McCandless King Coulter & Graham in Butler, filed the request Sept. 27, arguing that the school masking order mandated by acting state Secretary of Health, Alison Beam was not permitted by law.

Commonwealth Court Judge Christine Fizzano Cannon issued the decision late Wednesday morning.

Breth filed the application for summary relief of the school mask mandate on behalf of several schools and parents, including Calvary Academy in Butler.

Beam issued the order Aug. 31 that all students, staff, visitors and anyone entering any public or private school in Pennsylvania wear a face covering.
