Man kicks car door, hurts officer, police say
A domestic incident escalated this weekend as a Callery man began flailing in the back of a police cruiser.
Jason D. Luna, 49, was arrested Friday night, after he allegedly assaulted his girlfriend at the couple's home on Main Street Extension in Callery.
“Luna began to scream and kick the patrol car door window while hitting his head off of the divider,” said the investigating officer. “(An Adams Township Police officer) opened the rear door to get him to stop, at which point Luna kicked the door (the officer) was opening, with it hitting his left arm causing approximately a seven- to eight-inch scratch.”
That moment involving the officer prompted extra charges, according to documents filed Saturday.
District Judge William O'Donnell on Saturday arraigned Luna on one felony count of aggravated assault, one misdemeanor count of simple assault, one misdemeanor count of possessing drug paraphernalia and one summary citation for harassment.
Following the arraignment, Luna was taken to Butler County Prison on $25,000 bond.
According to charging documents, police had been dispatched at about 10:32 p.m. Friday to investigate a disturbance at Luna's home. Police said Luna had called 911 himself and hung up after getting upset over dispatchers asking him questions.
“Dispatch, (who) called the reporting party back, identified as Jason Luna, was notified his girlfriend is the female involved, and he wants her removed from the house,” police said.
Police said when they arrived, they found the girlfriend outside the home with “fresh injuries to her arms and right leg.”
According to police, the girlfriend told officers the injuries were from Friday night, and they included a visible welt on her right leg, a bruise on her left arm that was also bleeding, and a scrape on her right arm.
“According to (the girlfriend), Luna wanted another shot of alcohol. When she said, 'No,' Luna got very irate, threw her to the ground by grabbing her arms and she believes he kicked her which caused her leg injuries,” police said.
Police also talked with Luna about the incident, who claimed the fight was only verbal. Police said they did not see any visible injuries on Luna, but they saw blood on his foot, which they believed came from his girlfriend.
It was at that point, police arrested Luna with the intent to charge him with simple assault. The injury to the police officer prompted the felony charge. And, police entered the home, at Luna's request for a pair of shoes, they found 14 pipes, two bongs and a grinder, all marijuana paraphernalia.
“Luna claimed all the pipes, bongs and grinder were his,” police said.
A preliminary hearing for the case has been scheduled July 27 before District Judge Wayne Seibel.
