Man guilty of sending nude photos

Victim to deliver impact statement

WILKES-BARRE, Pa. — A Butler County man is to be sentenced later this month in Luzerne County on charges he sent nude photos of a former girlfriend to other men through Facebook.

Roy J. Yanvary, 45, pleaded guilty Monday to misdemeanor charges of selling obscene/sexual materials and unlawful dissemination of an intimate image.

His ex-girlfriend, a one-time Saxonburg resident, said she plans to deliver a victim impact statement when Yanvary is sentenced Jan. 31 before Luzerne County President Judge Michael Vough.

“I am relieved that this is almost finally over, so that I may continue with the long process of healing,” the 39-year-old victim said in a prepared statement emailed to the Butler Eagle.

The woman said she is still in therapy over her ordeal last year. She now lives in Lehigh County, where she works as a customer service coordinator for a bread bag manufacturer.

The Eagle is not identifying her due to the nature of the charges.

In exchange for Yanvary's guilty plea, prosecutors withdrew two additional charges of selling obscene/sexual materials and unlawful dissemination of an intimate image, both misdemeanors.

The defendant entered what is known as an “open plea.” Under that type of plea agreement, prosecutors do not make a sentence recommendation.

A telephone call to the county district attorney's office was not returned Tuesday. Yanvary's attorney, public attorney Brian Corcoran, declined to comment.

The defendant remains in the Luzerne County Prison, where he's being held for violating the terms of his bail in the case.

The victim said she moved from Luzerne County to Saxonburg for a job in June 2017, and later met Yanvary. She told police that she was in a relationship with him between June 2018 and April 2019.

During that time, she said she wasn't aware that he allegedly had taken nude photos of her.

Police said that the photos Yanvary sent through Facebook depicted Yanvary sleeping or passed out, and were taken without her permission.

The defendant allegedly told police that he had taken the nude photos of the victim with her consent for the purpose of having something by which to remember her.

Soon after the victim and Yanvary broke up, he allegedly sent more than a dozen images of the victim to a man through Facebook. The victim by then had moved back to Luzerne County, she said, to get away from the defendant.

A few days later, a second man allegedly received a photo of the victim in the nude.

When police confronted Yanvary about distributing the photos, he told them that he “must have been drunk and (angry) at (the victim),” according to a police complaint.

The victim, in her statement, reflected on her efforts to seek justice in the case.

“It took two weeks of daily phone calls with various courthouses and police departments,” she said, “to find a law enforcement agency with the will and wherewithal to file charges against my abuser.”

She also praised the county manager for putting her in contact with the county detective who investigated the case.

Additionally, she hoped her story would motivate other women to seek justice in similar cases.

“I encourage the many women who experience this type of crime, please don't be afraid to come forward,” her statement said. “Do not suffer in silence. Your attacker counts on you feeling shame even though this is not your fault.”
