Testimony details shooting by teen

CHICORA — Repeated cursing and the sound of gunfire was heard on a video clip played at a preliminary hearing Tuesday.

The video showed glimpses of the handgun and the blue pajama bottoms allegedly worn by the suspected shooter.

The prosecution alleged the video was taken by Adam J. Rodgers, 19, of Donegal Township with his cellphone in one hand as he fired a pistol, held in his other hand, in the early afternoon of Oct. 17 on New Hope Road in Cherry Township.

Rodgers' alleged target, Hunter Grossman, 19, of Cherry Township, the former boyfriend of the defendant's girlfriend, managed to run away and was not hurt, according to testimony.

District Judge Lewis Stoughton of Chicora ordered Rodgers held for court on attempted homicide and other charges in the suspected shooting.

The video also moved Stoughton to revoke the defendant's $500,000 bond.

“After watching that video, I was horrified,” the judge said, before announcing his decision to “absolutely just flat out deny bond.”

Rodgers was returned to the Butler County Prison following the hearing.

Trooper Brian Palko testified that state police were called around 1:30 p.m. to the victim's home on the 300 block of New Hope Road for a reported shooting.

Grossman “related that Adam Rodgers messaged him (on Facebook Messenger) that morning, calling him (a derogatory name) and wanting to fight,” Palko said.

Both teens, the trooper said, “agreed to, I guess, resolve their differences with a fistfight.”

Rodgers later showed up near Grossman's home. The victim went outside.

“Mr. Rodgers was calling (Grossman) names,” Palko testified, referring to the victim's account, “as they kind of walked toward each other.”

When the defendant displayed a black handgun, Grossman told police he began to retreat.

“During that retreat,” Palko said, “Mr. Rodgers began to fire multiple rounds towards the victim as he retreated.”

Prosecutor Robert Zanella, a county assistant district attorney, interrupted the trooper's testimony to play the video that Palko said police extracted from Rodgers' cellphone during the investigation.

Authorities allege that Rodgers recorded the video while holding the cellphone in his left hand and a pistol in his right hand, while running toward Grossman.

The voice on the video is believed to be of Rodgers cursing at the victim and telling him to “smile at the camera.”

Rodgers' face is not seen. Police believe he was wearing blue pajama bottoms, which are visible. A gun, at times, also is seen.

“What you got in your pocket?” the voice says. “You see what I (expletive) got mother (expletive)?”

A gunshot is heard.

After more profanity, a second shot is heard.

The voice says, “Smile (expletive), and a third gunshot is heard.

Grossman said he then saw a vehicle, later identified as a blue Dodge Caravan, “traveling in his direction.”

Grossman recounted he “retreated into the woods to get away from (the) vehicle,” the trooper said.

Police believe Tyler A. Martin, 17, of Worth Township was driving the minivan, and Henry A. Leroy, 19, of East Brady, Clarion County was riding in it.

The victim said as he ran into the woods he heard more gunshots.

On cross-examination, Rodgers' attorney, Stanley Booker of New Castle, questioned Palko if Grossman could see the gun being fired if he was running away.

“(Grossman) indicated he turned around and (saw) the weapon pointed at him,” the trooper said.

The minivan eventually left.

While investigating at the scene, Palko said, troopers recovered four .380-caliber casings on the road.

Investigators later found Rodgers, and he was taken into custody. Troopers found the minivan at a home on Haysville Road in Fairview Township, where they also found Leroy and Martin.

Martin and Leroy later told investigators Rodgers had requested a ride to the Boyers area and they complied.

Investigators believe Martin, Leroy and Rodgers drove to the home on Haysville Road, where the gun was disposed of, and Rodgers changed his clothes.

Police eventually got a search warrant for the home and recovered the clothing, including the pajama bottoms, that Rodgers was wearing at the time of the alleged shooting. They did not find the gun.

Police later arrested all three teens. But on Oct. 22, prosecutors withdrew charges of attempted homicide and aggravated assault against Leroy “for further investigation.”

On Oct. 29, Martin waived to court charges of attempted homicide, aggravated assault, conspiracy and tampering with physical evidence. He is free on $100,000 unsecured bail.

At Tuesday's hearing, Booker asked Stoughton to dismiss some of the charges against Rodgers, arguing the prosecution failed to show there was an agreement between his client and Martin to shoot the victim.

But Stoughton held Rodgers for court on charges of attempted homicide, aggravated assault, conspiracy and tampering with physical evidence.

Palko testified police have not recovered that gun.
