Middlesex man brings up complaint over grass, pool

MIDDLESEX TWP — Middlesex supervisors heard from a man who reported his neighbor's property Wednesday night.

Jim Rodriguez lives along Central Drive, where he said he's been located for three years. He asked supervisors about the township's code for yard maintenance.

“Everybody around me lives in a damn jungle,” Rodriguez said. “They don't care about their grass. I care.”

Rodriguez showed supervisors views of his neighbor's property using pictures he said he took Tuesday. Specifically, Rodriguez said he's offended by the length of his neighbor's grass, the condition of his neighbor's swimming pool, and the things left in his neighbor's yard.

“The mosquitoes will carry you away,” Rodriguez said, “because he has a swimming pool with no cover on it that's green.”

Supervisor Chairman Mike Spreng said the township enforces mowing. Township manager Travis Cavanaugh told Rodriguez the code enforcement officer has been to the property about which Rodriguez is concerned.

“I know he's had that guy cut the grass,” Cavanaugh said.

Rodriguez said that isn't enough. He told supervisors he gets rats on his property and has a mosquito infestation.

Donald Marshall, supervisor vice chairman, reviewed Rodriguez's pictures. He said he wasn't sure if what he saw qualified as a nuisance violation.

“I'll be honest with you. I see a tractor there; I see bushes and trees, weeds growing up alongside this house,” Marshall said. “I don't know how I can tell somebody how to live.”

Rodriguez said he can't sell his house because of his neighbor. He called the situation “unbelievable.”

“It's a cesspool,” Rodriguez said. “But that's OK.”

According to Chapter 115-1 of the township's code as posted on the township website, a nuisance is defined as “any use of property or conduct, or activity or condition upon property within Middlesex Township that shall cause or result in annoyance or discomfort beyond the boundaries of such property which disturbs a reasonable person of normal sensitivities, taking into consideration the location of the use or condition and the nature and condition of the surrounding neighborhood.”

Enforcing violation penalties is at the discretion of the township.
