EVANS CITY — An Evans City man accused of providing drugs to an Adams Township man who died of an overdose has turned himself in.

A preliminary hearing for Robert Denton Fugate II is scheduled for Aug. 20 after he turned himself in at his arraignment Monday.

Fugate was released on a $50,000 unsecured bond.

Fugate is accused of providing drugs to an Adams Township man who police said died of an overdose from the drugs. He is charged with drug delivery resulting in death — a first-degree felony considered equivalent to third-degree murder — and possession of a controlled substance with intent to deliver.

Tom McKinley, Fugate’s defense attorney, told District Judge Wayne Seibel that Fugate should not be considered a risk to flee. He said Fugate lives in Evans City with his girlfriend and has a local job.

Fugate’s parents, his girlfriend and her parents were in attendance at the arraignment.

“Obviously, they’re going to be here to be supportive of him in any way necessary,” McKinley said.

Officer Jessica Simons countered McKinley’s argument, saying that Fugate told police he would turn himself in on Aug. 1, one day after the warrant was issued, but failed to do so. McKinley told Seibel that Fugate was getting legal representation that day.

As a condition of Fugate’s release, he is required to undergo drug testing weekly. If he fails to show for his Aug. 20 hearing, another warrant will be issued for his arrest.

“There are conditions to this bond,” Seibel told the defendant. “And due to the seriousness of these charges, you would be wise to obey them.”
