A Pittsburgh man accused of raping a teenager waived his right to a hearing during his formal arraignment on Tuesday, allowing the case to continue.

Tod Gallagher, 49, of Pittsburgh was charged earlier this year with criminal attempt-rape forcible compulsion, criminal attempt-rape unconscious victim, corruption of minors, rape forcible compulsion, rape unconscious victim, all felonies and two misdemeanors of indecent assault without consent and indecent assault forcible compulsion for an alleged incident on Nov. 9, 2014. His lawyer, Robert Mielnicki, said Gallagher maintains his innocence.

Mielnicki wondered why it took authorities so long to bring the case forward.

“I found it strange that this case happened so long ago,” he said. “I don’t even know what (the victim) remembers or if she’s even identified Gallagher as the offender.”

On the date in question, township police received a call at 1:40 a.m. from the victim, who said she had been kidnapped “and someone wants to kill her.” When police found her, she told them that Gallagher and another man had picked her up after a Facebook exchange.

She told officers that she became intoxicated and woke up on the side of a road with her pants pulled down and a man on top of her, police said.

She struck the man in the head and managed to run away into the woods, documents state.

She was taken to a hospital, where a sexual assault kit was completed and the results confirmed what she told police, according to the documents.

Gallagher is free on $25,000 bail.
