A Portersville man on probation for pleading guilty to threatening another person with a rifle will be reunited with three of the four guns that were confiscated when he was arrested in 2017.

Walter M. Madden, 68, asked the court to return his property, including the guns, that was taken from him at the time of his arrest by state police.

On Wednesday, county Judge Timothy McCune partly granted Madden's request by allowing the return of three of the guns. The fourth gun, however, will not be given back since it was used in the incident.

As part of Madden's probation, he is not allowed to purchase firearms, but he is permitted to retain ownership of guns that he had already purchased.

Madden pleaded guilty Aug. 9, 2017, to one count of misdemeanor recklessly endangering another person and a summary charge of driving on a suspended license.

In accepting the plea deal, Madden's other charges were dismissed. They included misdemeanor terroristic threats, simple assault, disorderly conduct and criminal mischief after an incident on April 15, 2017.

According to state police, Madden arrived that day at a home in Slippery Rock Township with a gun. The person he was looking for wasn't home, so Madden left, police reports said. Later, Madden called the same home and spoke to that person.

“You're a dead man,” Madden said, according to court documents, threatening to shoot the man.

Madden admitted to police that he went to the home with a .22-caliber rifle after an argument with that person. That gun — a Marlin Model 25 — as well as a scope and magazine on it will not be returned to him.
