Court denies bond modification in drug case

A Michigan man continues to be held in Butler County Prison after a bond modification request was denied in court Friday.

Daveon S. Thompson, 24, of Detroit, will continue to be held on $200,000 bail after President Judge Thomas Doerr denied the motion.

Thompson's attorney, Rebecca Black, argued that Thompson has been held for four months after his arrest in March, and called the bail “excessive.”

He initially was held on $500,000 bail, but that had been reduced to the $200,000 at the preliminary hearing.

“Mr. Thompson has caused no additional delays to this case,” she said. “There is nothing indicating that he is a flight risk, and he has a supporting family and everything necessary to appear at further court proceedings.”

Assistant District Attorney Laura Pitchford argued that Thompson has no ties to Butler County and has several arrests for drugs, though there have been no convictions.

“There was a large amount of drugs when he was arrested,” she said.

State police filed charges of felony dealing in proceeds of unlawful activities, possession with intent to deliver a controlled substance, conspiracy, misdemeanor drug possession, possession of marijuana and possession of drug paraphernalia after the March 28 incident, where they said Thompson and William V. Beavers Jr., 27, also of Detroit, were dealing drugs from a home on Saxonburg Road, Butler Township.

About 4 ounces of suspected crack cocaine, 5 grams of suspected heroin and $3,400 in currency were seized in the operation authorized by a sealed search warrant, police said.

The tenant at the rental home, Jack H. Hartle, 63, and a visitor, Heather A. Kuhrt, 33, of Center Township, both suspected of drug dealing, were also arrested.

Police said when members of the state police Special Emergency Response Team entered the home they found the four inside.

Thompson had a plastic baggie with about 11 grams of suspected crack cocaine in it and Beavers was holding $360 cash, according to court documents.

Police said they found Hartle with three baggies containing a combined 9 grams of suspected crack in his left sock. Kuhrt was caught with a used syringe.

A search of one bedroom turned up two plastic bags with a total of about 100 grams of suspected crack, a plastic bag with what appeared to be heroin, and a bottle with suspected marijuana.

In the second bedroom, police said, was a baggie containing an unidentified white substance and $2,905.

Another plastic baggie with suspected crack in it was found in the bathroom, police said.

Drug packaging materials, three scales and five cell phones were also seized from the house.

Kuhrt was released after posting $25,000 bail, Hartle remains held on $100,00 bail and Beavers remains held on $250,000 bail.

All are scheduled for jury selection on Aug. 9.
