Cases include drug delivery

A Butler man pleaded guilty Tuesday to three cases, including drug delivery, retail theft and driving under the influence.

Vincent M. Yandura, 33, pleaded guilty to felony conspiracy to possession with intent to deliver a controlled substance and misdemeanor retail theft and DUI controlled substance before President Judge Thomas Doerr.

The plea agreement calls for a sentence of the county Intermediate Punishment Program, with the duration up to the court at sentencing, with the first 10 months on house arrest with electronic monitoring. He is also expected to be sentenced to pay fines, restitution and court costs and complete 50 hours of community service. Yandura is scheduled for sentencing on Aug. 22.

He was initially charged with felony possession with intent to deliver a controlled substance, criminal use of a communications facility and conspiracy counts to the previous two charges, as well as possession of a controlled substance, possession of drug paraphernalia and conspiracy counts to those two charges after an incident on March 10, 2017.

State police filed the charges after they say he conspired with Mary Boring to deliver crack cocaine in the 200 block of North Washington Street in Butler.

Police said a confidential informant went to Boring's home to make the purchase, when the two got into the informant's car and drove to the 300 block of East Jefferson Street, where Yandura got into the vehicle.

The vehicle then drove to East Brady Street and Yandura got out and walked away, before returning shortly, and the vehicle returned to Boring's home.

The informant reported that after giving Yandura the money, he handed the informant a baggie of drugs.

He pleaded guilty to the conspiracy to possession with intent charge in that case.

Yandura was also charged with misdemeanor retail theft and conspiracy to commit retail theft after an incident at Walmart, 400 Butler Commons, Butler Township, on Nov. 8.

Butler Township police said Yandura, along with Tyler W. Smith, 20, of East Brady, Clarion County, attempted to steal $190.41 in unpaid merchandise, including an air purifier, cherries, women's shoes and two iced coffees, according to court documents.

Police said Yandura admitted that the items were for a female friend.

He pleaded guilty to the retail theft charge in that case.

Yandura was then charged with three misdemeanor counts of DUI controlled substance and summary traffic violations following an incident on Dec. 9.

State police filed the charges after a traffic stop on East Cunningham Street in Butler.

Police said the vehicle was pulled over for a burned out brake light, and Yandura was found driving and intoxicated.

Documents state that Yandura admitted to taking heroin and cocaine prior.
