ZELIENOPLE — A Zelienople man faces charges after allegedly raping a woman in May of last year.

Tyler Herrmann, 24, of Zelienople is charged with rape, sexual assault, aggravated indecent assault and indecent assault. Jackson Township police filed the charges Tuesday.

Officers were dispatched to UPMC Passavant Cranberry on May 7, 2017, to interview a woman who said she was a victim of sexual assault, documents state. Arresting officer Michael Murcko interviewed the woman, who told him she was raped by Herrmann after hanging out with friends on the evening of May 5 and into May 6.

The Butler Eagle does not identify victims of alleged sexual assault.

The woman told police Herrmann picked her up at her home to go on a “burn run” and eventually met up with others at a house in Zelienople. The woman admitted they smoked marijuana, documents state.

At some point, the woman fell asleep and woke as the others were planning to leave. She asked Herrmann to take her home but he said he wasn’t ready to, documents state.

“They sat on the couch for a while watching TV. Herrmann made several comments to (the woman) asking why she looked unhappy and stated he could change that,” the report states. “At this point (the victim) stated that Herrmann forced himself on her.”

In a written statement, the woman recounted in detail the alleged assault, which continued despite her repeated protests. Herrmann then dropped her off at her home, documents state.

The woman said she stayed in bed for much of the next day, upset about what happened, and took a shower. A close friend later visited with her, and she discussed what happened with him, documents state. He encouraged her to go to the hospital for help.

During the ensuing investigation, the woman consented to a wiretap conversation with Herrmann conducted by Murcko, Detective David Aldridge of the Butler County District Attorney’s Office and state Trooper Max DeLuca, documents state.

“During the consensual wiretap, Herrmann makes an admission and then apologizes for the events of that night,” documents state.

In a later interview, Herrmann allegedly told officers, “he should not have continued” when the woman told him to stop. Investigators also completed a rape kit and found Herrmann’s DNA on the woman’s sweat shirt, documents state.

Herrmann was arraigned Tuesday and will have his preliminary hearing July 31. He is free on $25,000 unsecured bond, according to court documents.

His attorney, Stephen Misko, declined to comment Tuesday.
