Immediate parole in assault case
An Armstrong County man was immediately paroled Thursday, after being sentenced for assault on a trooper.
Brian L. Rosenberger, 25, of Kittanning, was sentenced to 3 to 12 months in Butler County Prison, and was immediately paroled on time served by Butler County Judge William Shaffer. His parole will be followed by 6 months on county probation, and he was ordered to pay court costs.
Rosenberger previously pleaded guilty to felony aggravated assault March 7.
He was initially charged with felony aggravated assault, misdemeanor resisting arrest, disorderly conduct, trespass, criminal mischief, possession of drug paraphernalia and summary public drunkenness after an incident Dec. 18, 2016. The paraphernalia charge was later withdrawn at the preliminary court level, and the remaining charges were dismissed as part of the plea.
State police said following a report of an intoxicated man who refused to leave a home on Iron Bridge Road in Winfield Township, Rosenberger got angry with troopers and kicked a decoration off the coffee table before charging a trooper, who took him to the ground.
Rosenberger continued to resist as he was taken to the patrol car, police said. He kicked the car and fell down. When he was eventually placed in the car, he spit at another trooper, hitting her in the right hand.
The troopers placed a spit mask over Rosenberger's head to prevent him for spitting any more, documents said.
At the barracks, he then kicked and damaged a room heater. Additionally, he was found with a suspected drug-smoking pipe, according to court documents.
