Dana E. Martin III, 22, of Clay Township was charged by state police Jan. 30 with being more than 2½ times the state’s legal limit for alcohol after a one-vehicle wreck last year in Petrolia that left him hospitalized with injuries.

Police said they were called to the crash about 11 a.m. July 22 on Argyle Street. Emergency crews found that Martin had been thrown out of his pickup truck, according to court documents, and was pinned under the frame.

It appeared, investigators said, that the defendant had lost control of the truck, struck an embankment and became airborne before rolling end over end. Police noted that the crash scene was 255 feet long and the road was closed for about two hours.

Martin was removed and taken to UPMC Presbyterian hospital in Pittsburgh with unspecified injuries.

At the crash scene, according to court documents, police found empty beer cans, a bottle of whiskey and a clear plastic cup with what appeared to be whiskey in it.

The investigating trooper said witnesses in Petrolia also reported that a truck matching the description of the defendant’s pickup was traveling through the borough “at speeds they estimated at 100 mph and doing burnouts in the streets,” documents said.

Police eventually got a search warrant for medical records at the hospital. Toxicology results showed Martin’s blood-alcohol level was 0.202 percent. In Pennsylvania, a level of 0.08 percent is considered intoxicated.

Martin is charged with driving under the influence, driving with a suspended license-DUI related, driving with a blood-alcohol level of 0.02 percent or greater while under suspension, driving at an unsafe speed, careless driving, failing to keep right, driving a vehicle without insurance and without valid inspection.
