A Beaver County man charged with fleeing from police was sentenced to probation in Butler County Court on Thursday.

Benjamin V. Cunningham, 27, of Fombell, was sentenced to 12 months probation, a $25 fine and to pay court costs by Judge William Shaffer.

Cunningham pleaded guilty to misdemeanor fleeing or attempting to elude law enforcement and summary failure to yield to an emergency vehicle on Sept. 25.

He was initially charged with the fleeing count, misdemeanor possession of marijuana, the summary failure to yield charge and driving on a suspended license after an incident on Dec. 19.

The remaining charges were dismissed as part of the plea.

Zelienople police filed the charges after they spotted Cunningham's vehicle on New Castle Road with an expired registration and found he had a suspended driver's license.

An attempted traffic stop of Cunningham on Route 228 in Franklin Township, Beaver County, resulted in a pursuit. After pulling into the driveway of 123 Lutz St., which was found to be Cunningham's home, police found Cunningham was driving and arrested him.

Cunningham stated he ran because he knew he had a warrant out of Westmoreland County. When police checked, no warrant existed, the document states.
