A Pittsburgh man charged with assaulting his prison cellmate, as well as county jail personnel, was sentenced to state prison on Thursday.

Dorian D. Holmes, 20, was sentenced to 22 to 44 months in a state correctional facility by Judge Timothy McCune, after previously pleading guilty Oct. 20 to three felony counts of aggravated assault. He was also ordered to pay $200 in fines and court costs.

Holmes was initially charged with felony rape, sexual assault, and two counts each of involuntary deviate sexual intercourse forcible compulsion, aggravated assault and aggravated indecent assault-forcible compulsion after an incident on July 17, 2016; as well as three felony counts of assault by a prisoner and two counts of aggravated assault, after an incident on March 19.

The July charges stem from an incident at the Butler County Prison in which police say Holmes assaulted and raped his 20-year-old prison cellmate, who was incarcerated on a drunken driving charge.

According to an affidavit of probable cause filed by Butler County detectives, the victim said Holmes at first only “bullied” him — including smearing toothpaste on him and not allowing him out of his bunk bed. But the incidents soon escalated to physical violence and sexual assault.

The assaults continued until a fellow inmate alerted a corrections officer who removed the victim, who was later transported to Butler Memorial Hospital, according to court records. He was released from the county prison on July 29.

Holmes had been in the prison since June 5, 2016, following his arrest in a reported riot at a northern Butler County juvenile detention center.

Holmes, then a student-inmate at the Western PA Child Care in Allegheny Township, was accused of breaking out of his room during the incident and possessing a homemade weapon. He pleaded no contest to those charges and was serving a 3-to 12-month sentence at the county prison at the time.

The parents of the victim spoke to the court Thursday, detailing the problems their son has experienced since the incident.

The man's mother told McCune that her son suffers from post-traumatic stress disorder, anxiety and depression.

“I fear for the next victim,” she said.

His father addressed Holmes directly, saying “I will never forgive you, his mother will never forgive you.”

“I've dreamed of choking the life out of you for what you did to my son,” he said. “You are nothing but scum.”

The other case involves Holmes biting and kicking two correctional officers during an incident at the jail.

Police said the officers were escorting Holmes back to his cell after he became unruly in the recreation area and tried to tamper with his restraint belt. He then kicked an officer in the stomach and was taken to the ground, and when other officers attempted to restrain him, he bit them in the hand and arm.

Prison staff eventually got control and placed Holmes in the behavioral management unit.
