PITTSBURGH — A federal judge on Wednesday dismissed a lawsuit, at the request of the plaintiff’s attorneys, that was filed against the Butler School District and several former administrators.

The plaintiff plans to re-file the suit in state court.

Jennifer Tait, whose daughter is a Summit Elementary School student, filed the original suit Feb. 11 seeking medical monitoring and damages for any individuals exposed to lead and copper in the drinking water at the school.

The defendants listed include the school district, former superintendent Dr. Dale Lumley, former assistant superintendent Mary Wolf and former maintenance supervisor Glenn Terwilliger. Their defense attorneys had filed a motion to dismiss the case on June 1.

On Tuesday attorney Brendan Lupetin asked the court to dismiss the suit without prejudice, meaning it could be refiled.

Judge Arthur Schwab today granted the request and ordered the case to proceed with alternative dispute resolution.
