Adams refines requirements

Supervisors remodel apt. ordinance

ADAMS TWP — The township ordinance governing apartment buildings on Route 228 has changed.

The township supervisors Monday evening updated the requirements for new apartment buildings in the Route 228 overlay district.

The revised ordinance calls for a minimum 5-acre plot, a public access road, no lot minimums, certain setbacks, and a five-story or 75-foot height maximum.

Township solicitor Mike Gallagher explained that the supervisors and developers looked at the current ordinance for apartments along Route 228 and decided that updates were needed.

Gallagher said the planning commission then developed an ordinance, which was approved by the supervisors.

After the public hearing on the ordinance, Gary Peaco, township code enforcement officer, explained that developer Chris Kaclik, a prolific developer in Adams, recently presented a plan for apartments on Route 228 behind Mars Bank.

Peaco said he realized then that the former ordinance did not fully address apartments. He said if the township ignored the issue, a developer could potentially challenge the ordinance in court.

“It was ‘If we allow apartment buildings, where is the best place for it to be?’” Peaco said.

Kaclik attended the meeting, but did not comment on the revision.
