Neighbor arrested, tased
PROSPECT — A long-standing neighbor dispute ended with a 58-year-old borough man under arrest but not before state police shot him with a Taser.
The suspect, Gerry P. Foster, is accused of cutting two trees on the other property and choking his neighbor during the altercation Monday on Schantz Road.
Foster was later arraigned on charges of resisting arrest, two counts each of criminal mischief and defiant trespass, and harassment. He is free on his own recognizance.
The alleged victims, Chad and Diane Green, notified police after they heard trees being cut down outside their home. They went to check and found the damaged trees and an extension cord for a saw coming from Foster’s house, according to court documents.
The Greens, who provided a trooper with a copy of a land survey for their property, told police two years ago they had a prior dispute with Foster after he dug a hole in their yard.
A short time later police were called back when the dispute erupted again. The second call was prompted when Foster put his hands around Chad Green’s throat and stomped on his chest, police said.
After Foster repeatedly refused to stop and at one point pulling away, the officer deployed his Taser, which dropped Foster, police said.
His preliminary hearing is May 4 at the office of District Judge William O’Donnell in Slippery Rock.
