Simple assault charges filed in road rage case

JACKSON TWP — Two men were charged with simple assault following a road rage incident in Evans City at the end of August, but both men gave different accounts of the incident.

Kevin R. Lenz, 61, and Richard Curtis Pisarchick, 54, both of Evans City, are charged with simple assault, disorderly conduct hazardous physical offensive condition, harassment and careless driving.

Lenz is an instructor for the D.I.A.N.A. (Driving In A New America) driving school, which has done classes for the Butler, Mars and Seneca Valley school districts. The school’s name is in honor of his teenage daughter, Diana, who died in a car accident in 1999.

Lenz claimed he was the victim of an aggressive road rage situation. He noted that he called the police.

Despite feeling he is a victim, Lenz said he fears this incident will tarnish his reputation and the reputation of his business.

According to court documents, officer Christopher Miller of the Jackson Township police was dispatched Aug. 21 to the intersection of Pattison Street Extension and Kaufman Road for an incident called in by a witness. The witness reported that two men were fighting. It was reported that one male left in an SUV headed toward Evans City.

According to documents, Lenz and Pisarchick began fighting due to a few incidents that occurred when they encountered each other earlier on Franklin Road.

Lenz was driving on Franklin Road in his marked driving school vehicle and an SUV driven by Pisarchick approached him from the rear at a high speed and began tailgating him, the documents state.

Pisarchick stated in the documents that Lenz was driving below the posted speed limit.

Lenz stated in the document that he motioned out the window with his hand and thumb extended for the vehicle to back off.

Pisarchick stated that he saw Lenz waiving out the window and thought he did not have a working turn signal. He then claims he saw him display his middle finger.

Pisarchick stated that he noticed the vehicle was marked with a student driver sticker and one that said stay back 100 feet. Pisarchick stated that he backed off until the sharp curves on Franklin Road. When he came around the bend, Lenz was going below the speed limit and then began brake-checking him.

Lenz said Pisarchick then passed him on a sharp curve. Pisarchick stated he tried to pass Lenz, after seeing there was no oncoming traffic.

Both vehicles approached Kaufman Road and both turned left. Lenz stated the SUV, a 2003 Chevrolet TrailBlazer, stopped in the middle of the road. Lenz stopped and Pisarchick stopped and approached Lenz’s vehicle yelling. They exchanged words, and Lenz left because he felt Pisarchick was threatening him, documents said.

In the process of leaving, Pisarchick alleged Lenz’s car struck his stomach and chest area. The back tire also allegedly ran over his right foot.

Lenz stopped at the stop sign, and Pisarchick approached from the rear and pulled around Lenz blocking the road. Lenz said Pisarchick left his vehicle and began throwing objects at him in his car.

Pisarchick stated in the documents that he grabbed several tomatoes and began throwing them.

Lenz got out of his car and began arguing with Pisarchick when the men started to fight. Lenz stated Pisarchick punched him in the face.

According to documents, Lenz attempted to kick Pisarchick in the groin several times after being punched. Lenz was reportedly struck in the face several times. The fight stopped and Pisarchick left. Two witnesses saw Pisarchick and Lenz fighting, the documents state. A third witness who saw the entire fight said he saw Lenz get out of his vehicle and charge Pisarchick. That witness said Lenz attempted to kick Pisarchick several times, and Pisarchick fought back and hit Lenz.

Lenz had a broken nose and a left eye injury. Pisarchick sought medical treatment for his injuries. His foot injury was minor.

A representative at the Evan’s City District Court said the case is being moved to Cranberry Township.

No date has been set for a preliminary hearing.
