Couple pleads guilty to identity theft using cell phones

PITTSBURGH — Two former Butler County residents accused of stealing people’s identities using cell phone cameras in Wal Mart changed their pleas from not guilty to guilty.

Robert W. MacVittie, 35, and Jennifer MacVittie, 32, formerly of Cranberry Township, were indicted by a federal grand jury in July 2014 and initially pleaded not guilty in December of that year.

But on Friday they each pleaded guilty to counts of aggravated identity theft and conspiracy before U.S. District Judge Joy Flowers Conti, according to a news release from U.S. Attorney David J. Hickton.

They are accused of using cell phone cameras to “shoulder surf” Social Security numbers from Wal Mart customers who were cashing checks at customer service counters.

They then allegedly wrote counterfeit checks at Wal Mart stores around the county. That included Pennsylvania, West Virginia, Florida, Texas, Mississippi, Alabama and Kansas.

The couple was arrested at a casino in Nevada in November 2014.

They are scheduled to be sentenced in January. The law provides for a maximum sentence of seven years in prison, a $500,000 fine, or both, according to the release.
