Harmony approves variance for subdivision of property
HARMONY — The saga over the subdivision of a property ended Tuesday with council voting for the variance, but with conditions.
Monroe Street property owner Ann McGee had asked for a variance to the minimum frontage of 75 feet. She wanted to make one part of her property 65 feet and another section 68 feet of frontage.
The approval of council, comes some strings. The building permit for the property would have to be subject to a new FEMA ordinance governing flood control.
The flood plain ordinance has not yet been adopted by the borough. That is expected to come in 60 days.
Council solicitor Matt Racunas said the borough has put together a FEMA-approved floodplain ordinance that is “ready to go”
Racunas said all boroughs in Butler County are going to be required to update their floodplain maps to comply with federal requirements.
The approval came close to not happening after some discussion between Racunas and Magee’s attorney Jeffrey Thompson about the conditions.
“When the building permits are applied for, I would assume that whatever law is in place at the time is the law. It’s hard to agree to an ordinance that’s not passed,” Thompson said.
Racunas however said obtaining building permits for the subdivision wouldn’t be delayed.
McGee and Thompson agreed to the conditions.
