Man waives preliminary hearing

CRANBERRY TWP — The man who allegedly attempted to rob a dry cleaning business with a hypodermic needle last week appeared in court Friday after spending a week in prison.

Devan Ness, 25, of Cranberry Township turned himself in to township police Oct. 9 after he allegedly attempted to hold up Take it To the Cleaners on Freedom Road the day before.

Appearing before District Judge David Kovach, he waived his right to a preliminary hearing and will appear next in Butler County Court on Nov. 25 for a formal arraignment on a felony charge of attempted robbery.

He was represented by chief public defender Kevin Flaherty.

According to the criminal complaint, Ness admitted to detective Matthew Irvin he attempted the robbery because of a heroin addiction.

He also was caught on video surveillance of a nearby Valero convenience store about the time of the robbery wearing the same clothing as described by the clerk at the cleaners.

Officer Joshua Shimko said Ness has been in the Butler County Prison on $25,000 bail and that his family is concerned about his well-being if he were to be released.

Kovach asked Ness if he had cleaned up healthwise while in prison, to which he said “yes.”

“Most of the people mixed up in heroin they either end up in prison or they end up dead. I pray that you get yourself fixed up,” Kovach said.
