HARRISBURG — A federal judge says she won't order a halt to the criminal case against former Penn State president Graham Spanier, who's accused of a criminal cover-up of complaints about Jerry Sandusky.

U.S. Middle District Judge Yvette Kane on Friday dismissed the legal action brought by Spanier against state Attorney General Kathleen Kane, whose office is prosecuting him and two other former university administrators.

Kane's memorandum says her decision is based on a principle that requires federal courts to keep out of state prosecutions in all but the most extraordinary instances.
