PITTSBURGH — A judge has scheduled a Sept. 29 trial to determine whether deed covenants prevent selling Pittsburgh’s bankrupt August Wilson Center for African American Culture to a New York developer.

Dollar Bank wants to foreclose if the $9.5 million sale doesn’t go through. The developer, 980 Liberty Partners, wants to add a 10-story hotel to the property, while still providing space for the arts center.

The Pittsburgh Urban Redevelopment Authority contends that sale would violate deed covenants requiring the building be used exclusively as a black cultural center.

The bank has scheduled an Oct. 6 sheriff’s sale because it’s owed about $7.9 million.
