Homeowner says promised buffer zone not in new plans

MIDDLESEX TWP — A resident of the Weatherburn Heights housing development said a promise made by builder Ryan Homes three years ago has not shown up on drawings for the neighborhood’s latest phase.

Dean Bova, who bought his home on Eagle Ridge Drive two years ago, said developers ensured him and several of his neighbors that two, 50-foot buffers of green space would separate their backyards from those in the plan’s future fifth phase.

But Bova said plans at the township building for the fifth phase do not include any space between his backyard and those planned for the new phase.

“We were clearly misled,” Bova told the township supervisors Wednesday night.

He said language in Weatherburn’s homeowners association documents also state that the 100-foot buffer was to be placed between Eagle Ridge Drive property lines and those in the fifth phase.

Bova said many of the neighborhood children play in the green space behind the Eagle Ridge Drive property lines, and many residents cut the grass in the space during the summer for that purpose.

He said he bought the property with the understanding that the space would be there, even after the plan’s fifth phase was added.

“This is why people move out of Allegheny County,” Bova said of the close quarters shown in the drawings.

Township solicitor Mike Hnath said he and the supervisors would look at the situation.

Township manager Scot Fodi told Bova to attend the March 18 public hearing when developer Gigliotti Properties will seek approval for Weatherburn Heights’ fifth phase.

Residents will be given the opportunity to testify at the public hearing.

Bova said he has not contacted Ryan Homes or Gigliotti Holdings regarding the changes in the drawings.
