Charges against 1 suspect dropped

Hearing set for 2 others in robbery

Charges against one of the three suspects in the violent robbery of an elderly woman at a Zelienople church have been withdrawn after authorities discovered she was not involved.

Evans City District Court officials said all charges against Kayla Maiolie, 24, of Imperial, had been withdrawn on Tuesday.

Butler County District Attorney Richard Goldinger said Maiolie was determined to be innocent of any accusations following an investigation and written statements submitted by the two other suspects in the incident.

“She was unsuspecting, unknowing, and didn’t now what was going on,” Goldinger said of Maiolie. “Both of the other suspects provided signed, sworn statements that she was not involved.”

Maiolie was one of three suspects in the Jan. 28 robbery and assault of a 70-year-old woman on Pittsburgh Street in Zelienople.

The other two suspects — Elliot J. Mullen, 34, of Carnegie, and Marquita J. Mullen, 30 — also of Carnegie — are facing a slew of charges related to the incident. The pair has a preliminary hearing scheduled for 9:25 a.m. Tuesday in Evans City District Court.

Elliot Mullen is facing charges of suspicion of simple assault, robbery, criminal conspiracy, and receiving stolen property. Marquita Mullen is facing charges of robbery, criminal conspiracy, criminal mischief, receiving stolen property, and driving while operating privileges have been suspended or revoked.

The incident occurred at about 2 p.m. outside the Zelienople Harmony United Methodist Church, where the elderly woman had an appointment. According to court reports, the woman arrived at the church early and was approached by Elliot Mullen, who is accused of asking to use her phone before grabbing her purse and a briefcase while knocking her to the ground.

The two struggled for the items while the woman screamed, court documents allege. Elliot Mullen reportedly got into a waiting vehicle and left the scene.

A witness to the incident reported the vehicle and license plate number to authorities. A Cranberry Township police officer later spotted the vehicle and followed it to Allegheny County, where — assisted by other agencies — it was stopped. Elliot Mullen allegedly attempted to flee officers on foot before being caught and arrested along with Marquita Mullen and Maiolie.

Goldinger said the incident apparently was a planned attack that Elliot Mullen and Marquita Mullen have allegedly engaged in before.

“Apparently this was a situation where they were driving to a store to buy something. Maiolie was in the back seat,” Goldinger explained. “They had a plan where the driver would stop, the gentleman would jump out and snatch someone’s purse. Ms. Maiolie did not know what was going to happen.”
