BROWNSVILLE — A middle school student who sued her school district, claiming she was being punished for sitting during the Pledge of Allegiance, will no longer be disciplined for doing so, an attorney for the district said hours after the lawsuit was filed Monday.

The American Civil Liberties Union filed the lawsuit Monday morning against the Brownsville Area School District. According to a copy of the lawsuit, the unnamed student has been “disciplined and scolded repeatedly” for respectfully sitting during the pledge.

But on Monday afternoon, school district solicitor James Davis said that the unidentified student’s decision not to stand is a constitutionally protected right. That’s what the ACLU had said in the lawsuit.
