Prison overtime lawsuit targets county
Butler County is being sued by a corrections officer at the county prison for allegedly failing to pay overtime compensation.
Corrections officer Sandra Babcock of Franklin Township filed civil lawsuits in both federal and county court.
In a civil case filed Feb. 23 with U.S. District Court in Philadelphia, Babcock alleges the county has an unlawful wage payment system because she wasn’t paid overtime for 15 minutes of each 8-hour, 15-minute shift.
During each 1-hour meal break, when officers aren’t permitted to leave the prison, they are on call for any emergencies. Of that hour, officers are only paid for 45 minutes. The remaining 15 minutes are unpaid.
The civil complaint alleges Babcock and other officers should have been paid overtime for that 15 minutes each day.
Babcock is accusing the county of violating the Fair Labor Standards Act for the past three years the work day schedule has been used.
Babcock also filed a class-action lawsuit in county court.
Julie Graham, county solicitor, said the county hasn’t been served with the second complaint yet.
