COLUMBUS, Pa. — A northwestern Pennsylvania township has repealed an ordinance that would ban Marcellus Shale drillers from dumping some toxic wastewater in abandoned wells within its borders.

Columbus Township secretary Mary Ann Burge tells The Associated Press the ordinance was repealed Tuesday.

The Pennsylvania Independent Oil and Gas Association claimed in a federal lawsuit filed last month that the ordinance violated the Constitution`s interstate commerce clause. The ordinance banned dumping wastewater not generated by drilling within the township.

A Pittsburgh newspaper first reported Thursday that the group dropped its lawsuit. The group’s attorney says it did that because the ordinance was repealed.

Columbus Township is in Warren County, about 30 miles southeast of Erie. It passed the ordinance in August and amended it last month.
